Traffic fine abroad
Did you commit a traffic violation abroad? Then there is a big chance that you will be fined immediately when you are stopped by the police. Sometimes you also have to pay immediately. Are you flashed? Then you will receive the fine at home. But even then you cannot avoid paying.
Arrested
If you are stopped and pay your fine in cash immediately, you should know that paying your fine amounts to admitting guilt. You can then no longer appeal. You may also have to pay a deposit, usually equal to the fine. Ask for confirmation of payment if you want to appeal. You may not have to pay the fine immediately. You still have the option to appeal. Note that the sooner you pay, the lower the fine.
Flashed
If you are flashed and not stopped, the ticket will be sent to your home address. According to European law, foreign authorities can find out your name and address based on your license plate.
Still haven't received a fine after a while? Don't count your chickens before they hatch, because this can sometimes take months. The fine you receive at home states within what period you have to pay the fine. Here too, paying quickly is often cheaper. Of course, you can also appeal the fine.
Not driven yourself?
Do you receive a fine from abroad and did you not drive yourself, for example because you lent your car? Then you can often avoid the fine if you can prove that someone else was the driver. In many countries, the driver and not the license plate holder is responsible, as is the case in the Netherlands. In Germany, for example, they focus on the driver instead of the owner. Do not think that you do not have to pay a fine from abroad that is sent to you at home. The fine can be collected 'simply' in the Netherlands by the CJIB. If you do not pay, you will also end up in the foreign investigation register and you can be stopped at the border or during a traffic check. You will then have to pay immediately.
Driving ban or suspension
For certain violations, you may be given a driving ban in addition to a fine. This only applies in the country where you were given the ban.
A driving ban is different from a driving ban, or driving disqualification. This is imposed for more serious violations. With a driving ban, you must surrender your driving license. Your driving license will then be sent – immediately or at the moment the driving ban is lifted – to the RDW, who will send it to your municipality. Note that as long as you do not have a valid driving license, you are also not allowed to drive in the Netherlands!
To object
Do you think your fine is not justified? Then you can file an objection. In the objection, you must argue why you think the fine is not justified. For example, because the license plate is incorrect or that you were not there. Of course, you must be able to substantiate this with evidence. If you are proven right, the fine will be cancelled. If your objection is rejected, you can still appeal (to a higher level).
